🐧 Tiny Penguin

Terms of Service

Effective October 12, 2026

In short: Flotilla is yours to use on your Macs. The free features cost nothing, Pro is a subscription you can cancel any time, payments go through Paddle, and your code never leaves your machine because of us. The AI agents you run are yours to answer for: follow the law and their providers' terms, check you're allowed to use them at work, and keep backups, because we aren't responsible for what they do.

1. Who we are

These terms are an agreement between you and Tiny Penguin LLC ("Tiny Penguin", "we", "us"). They cover Flotilla, any other Tiny Penguin app, and tinypenguin.com (together, the "Services"). By downloading or using the Services you agree to these terms. Questions go to hello@tinypenguin.com.

2. Your license

We grant you a personal, non-exclusive, non-transferable license to install and use Flotilla on Macs you own or control, for personal or commercial work. Please don't resell, sublicense or redistribute the app, reverse engineer it except where the law allows, or get around its plan limits. We and our licensors keep all rights in the software.

3. Accounts

Some features need a Tiny Penguin account, which you create with Sign in with Apple or a link sent to your email. Keep access to that account secure and its email current; you're responsible for what happens under it.

4. Free and Pro

5. Payments through Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Terms also apply to your purchase.

6. Refunds

You can get a full refund within 14 days of any charge. See the refund policy for how.

7. AI agents and third-party tools

Flotilla is a workspace for AI coding agents. It doesn't provide, train, control or monitor any AI model. The agents it runs are tools you install and sign in to yourself, such as Claude Code, Codex and Cursor, alongside other tools like git, the GitHub CLI and tmux.

8. Your work

Your code, projects and conversations are yours. Flotilla keeps them on your Mac, and we don't get a license to them by your use of the Services.

9. Crash reports and usage analytics

Flotilla sends crash reports, error reports and usage metrics to Sentry, our crash-reporting and analytics provider, so we can fix problems and see which features get used. It isn't linked to you and contains nothing from your code, prompts or transcripts. In the EEA, the UK and Switzerland Flotilla asks before sending any; elsewhere it's on by default. You can change it any time in Settings with "Send crash reports and usage data". The privacy policy lists exactly what's sent.

10. Updates and changes

Flotilla checks for updates and can install them for you. We may add, change or remove features over time. If we remove a Pro feature you rely on during a paid period, contact us and we'll make it right.

11. Disclaimer

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will be uninterrupted or error-free, that anything an agent produces is correct, secure or free to use, or that agents won't change, damage or delete your code, data or systems.

12. Limitation of liability

To the extent the law allows, Tiny Penguin won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or code, including any loss caused by AI agents or other tools run through Flotilla. Our total liability for any claim about the Services is limited to what you paid us in the 12 months before the claim.

13. Ending things

You can stop using the Services at any time. We may suspend or end your access if you break these terms. Sections 7, 8, 11, 12 and 14 survive.

14. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and both sides consent to their jurisdiction. Nothing here takes away rights you have under the consumer laws of where you live.

15. Changes to these terms

We may update these terms. When we make material changes, we'll update the date above and let you know in the app or by email before they take effect. Continuing to use the Services after that means you accept the new terms.
